AUDIBLE x WINGBOY “SPICY ROMANCE” COMPETITION
TERMS AND CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this competition (the “Competition”) is deemed acceptance of these Terms and Conditions. The promoter of the Competition is Emotive Pty Ltd (ABN 93 604 055 674) of 27 Alfreda Street, Coogee, NSW, 2034 (the “Promoter”).
1. WHO CAN ENTER OR BE NOMINATED?
1.1 Entry is open to all residents of Australia who:
a) are over the age of 18; and
b) have an account on either the Instagram or TikTok social networks; and
c) have ordered and received a "Spicy Romance Box" from Wingboy on either 20 or 21 September 2025,
(an “Entrant”).
1.2 Employees (and their immediate families) of the Promoter, Prize Providers, and agencies directly associated with this promotion are ineligible to enter or be nominated. “Immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stop-brother, step-sister, or first cousin.
2. HOW TO ENTER
2.1 The Competition commences on Saturday 20 September 2025 at 9:00am (AEST) and concludes on Monday 22 September at 11:59pm (AEST) (the “Competition Period”).
2.2 In order to enter the Entrant must:
a) order and receive a "Spicy Romance Box" from Wingboy on 20 or 21 September 2025;
b) upload a video of the Entrant showing their best unboxing of the "Spicy Romance Box" to either Instagram or TikTok and ensure the Entrant's profile is set to "public";
c) if the video is uploaded to Instagram, tag @audible_au and @wingboy_sydney and add the hashtag #AudibleSpicyPrize;
d) if the video is uploaded to TikTok, tag @audible and @wingboy_sydney and add the hashtag #AudibleSpicyPrize.
2.3 The entry must be:
a) the original, independent creation of the Entrant that has not previously been published in any form in any country in the world; and
b) free from any claims, including copyright or trademark claims by other parties.
2.4 Entries that are found to be derived from another person’s work will be considered invalid
2.5 Intellectual Property subsisting in the entries remains the property of the Entrant. The Entrant grants the Promoter and each of the Prize Providers the worldwide, perpetual, royalty-free, transferable right to use, edit, adapt, and exploit the entry, including by combining the entry with other entries or materials and via sharing or natively posting the entry via the Promoter's or Prize Provider's social media channels.
2.6 The Promoter reserves the right, at any time, to verify the validity of the entries and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached these Terms and Conditions, tampered with the entry process, or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted in the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any time does not constitute a waiver of such rights.
3. HOW TO WIN
3.1 All entries completed and submitted in accordance with these Terms and Conditions will be judged by representatives of Audible Australia Pty Ltd no later than Friday, 26 September at 17:00pm (AEST).
3.2 The pool of valid entries will be judged on creativity and the entry deemed to be the most creative will be awarded the Prize.
3.3 This is a game of skill. There is no element of chance in the judging of the Competition or determination of the Winner.
3.4 The Winner will be notified by private message via the Audible Instagram or TikTok account (depending on the social network the winning video is posted on) no later than 3 October 2025 (the “Notification Date”).
3.5 The judges’ decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result.
3.6 The Promoter reserves the right to request that the Winner provides proof of age and/or identity prior to awarding Prizes. Identification considered suitable for the verification is at the sole discretion of the Promoter.
3.7 If the Winner does not respond to the message sent under clause 3.4 above within 48 hours of message being sent, that Winner will forfeit the relevant Prize in its entirety and the Prize shall be awarded to the next runner up in the Competition. The Promoter will not be liable in any way to a Winner who does not respond to the Promoter’s contact attempt and therefore forfeits their Prize and no correspondence will be entered into. This process will be continued until a Winner responds to the message within the specified period.
3.8 It is a condition of accepting a Prize that the Winners must comply with all the conditions of use of the Prize and the Prize Provider's requirements (including terms and conditions of any service provided by a Prize Provider that forms part of the Prize). To the extent of any inconsistency with these Terms and Conditions, the terms and conditions of the prize supplier prevail.
3.9 The Promoter reserves the right to rejudge the Competition in the event that an Entrant, who was initially deemed to be the Winner, is unable to satisfy any of these Terms and Conditions.
4. PRIZES
4.1 The winner will be entitled to the prize (a “Prize”).
4.2 The Prize will consist of:
a) one (1) 12 month Audible Promotional Gift Membership valued at $164.50; and
b) one (1) $1,000 Wingboy voucher.
4.3 Total Prize value is a maximum of $1,164.50 (including applicable GST). Prize values are based upon the recommended retail prices and are correct as of 1 August 2025. The Promoter accepts no responsibility for any change in Prize value between now and the redemption date.
4.4 In relation to the Audible Promotional Gift Membership: Claim codes for Promotional Gift Memberships may only be redeemed at Audible.com.au for an Audible Premium Plus Promotional Gift membership. Claim code expires on 31 March 2026 at 11:59pm AEST. If you are an existing Audible customer with an active membership plan, upon redemption, your membership will not be extended, instead, you will receive audiobook credits in an amount equal to the number of months of the applicable Promotional Gift Membership. For full terms and conditions see https://www.audible.com.au/legal/gift-terms . Audible reserves the right to modify or cancel the offer at any time. Any terms prohibited by law shall be void without prejudice to the remaining terms.
4.5 Unless expressly stated in these Terms and Conditions all other expenses associated with redeeming the Prize are the responsibility of the Winners.
4.6 In participating in the Prizes, the Winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The Winners agree to grant the Promoter and Prize Providers a perpetual and non-exclusive licence (including the right to sub-licence) to use their name and such footage and photographs in all media worldwide and the Winners will not be entitled to any fee for such use.
4.7 Prizes are not transferable and cannot be redeemed for cash. The Winners should seek independent financial advice about any tax implications that may arise from the Prize winnings.
4.8 In the event that a part of a Prize is no longer available the Promoter reserves the right to substitute prizes in its discretion to the same and equal recommended retail value.
4.9 The "Prize Providers" are:
a) Audible Australia Pty Ltd (ABN 89 624 383 811); and
b) Wingboy HQ Pty Ltd (ABN 50 662 250 704).
5. NO LIABILITY
5.1 Any costs associated with entering this Competition or claiming Prizes (such as internet service charges) are the responsibility of the Entrant.
5.2 Subject to any restrictions in law and subject to clause 5.4, the liability of the Promoter and Prize Providers however arising, whether by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the Prize.
5.3 The Promoter and Prize Providers and their associated agencies and companies will take no responsibility for Prizes damaged or lost in transit, or late, lost or misdirected mail.
5.4 Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify any statutory guarantee that cannot be excluded, modified, or limited, including under the Australian Consumer Law (the “Non-excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Prize Providers (including their officers, employees, and agents) exclude all liability (including negligence), for any personal injury, and any other loss or damage (including loss of opportunity), whether direct, indirect, special, or inconsequential, arising in any way out of the promotion, including but not limited to in connection with:
a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b) any theft, unauthorised access or third party interference;
c) any entry or prize claim that is late, lost, altered, damaged, or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d) any variation in Prize value to that stated in these Terms and Conditions;
e) any tax liability incurred by a Winner; or
f) taking/use of and/or participation in the Prize.
5.5 The Promoter, Prize Providers, and their affiliates accept no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
5.6 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or for any other reason which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any legal action that may be available, or to cancel, terminate, modify or suspend the Competition, subject to applicable law.
5.7 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition.
5.8 Each Entrant acknowledges that this competition is in no way sponsored, endorsed, or administered by, or associated with Instagram or TikTok (or their affiliated entities).
5.9 Each Entrant releases each of Instagram and TikTok (and their affiliated entities) from any and all liability associated within this competition to the maximum extent possible at law.
6. PRIVACY
6.1 By entering this Competition, you agree to the Promoter collecting, using and disclosing your personal information for the purpose of conducting and promoting this Competition, in accordance with the Promoter's Privacy Policy which is available at https://emotive.com.au/wp-content/uploads/2025/05/Emotive-—-Privacy-Policy.pdf which you acknowledge you have read and agree to. This privacy policy contains important information regarding how the Promoter handles your personal information, including how you can access and/or correct your personal information, make a complaint about the handing of your personal information and the manner in which the Promoter may disclose personal information. Additionally, you agree that the Promoter will share the Winners’ personal information with Prize suppliers for the purpose of fulfilling the Prize and you acknowledge that each Prize supplier's use of such personal information will be subject to their own privacy policy, not the Promoter’s. Entry into the Competition is conditional upon providing requested personal information. If you do not provide personal information when requested, you may not enter the Competition.
